Terms and Conditions
1. Acceptance of These Terms
By accessing or using spimarine.com, including "The Current" market intelligence platform (together, the "Site"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, please do not use the Site. We may update these Terms from time to time; continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
2. About SPI Marine
The Site is operated by SPI Marine (Houston), Inc. on behalf of the SPI Marine group of companies, a specialty bulk liquid cargo shipping brokerage operating internationally across chemical and product tanker trades. References to "SPI Marine," "we," "us," or "our" mean the operating entity together with its affiliated SPI Marine group companies as context requires.
3. Use of the Site
You may use the Site for lawful business purposes related to evaluating or engaging SPI Marine's chartering, brokerage, and market intelligence services. You agree not to:
- Use automated tools, scrapers, or bots to extract, copy, or systematically harvest content from the Site, including market reports and trade lane data;
- Misrepresent your identity or affiliation when registering for gated content or subscribing to reports;
- Use the Site to transmit malicious code or attempt to gain unauthorized access to our systems;
- Reproduce, redistribute, or commercially exploit Site content without our prior written consent.
Nothing on the Site constitutes, and the Site is not intended to provide, any of the following:
- A recommendation, offer, or solicitation to enter into any chartering, freight, or trading transaction;
- Investment, financial, legal, or trading advice of any kind; or
- A guarantee of future freight rates, market conditions, or vessel availability.
4. Market Intelligence and Content Disclaimer
The Site publishes freight market commentary, trade lane analysis, and related content, including reports such as the regional "Current" series ("Market Content"). Market Content is prepared by SPI Marine's brokers and analysts and reflects their assessment of market conditions at the time of publication, drawing on our fixture data, trade flow analysis, and market relationships. Certain drafting and data-processing tools, including AI-assisted software, may support the preparation of Market Content, but all published Market Content is reviewed and finalized by SPI Marine personnel who take editorial responsibility for it before publication.
Market Content is provided for general informational purposes only. It is not:
Freight and commodity markets are volatile and influenced by factors outside our control. You should not rely on Market Content as a substitute for your own independent commercial judgment, and SPI Marine accepts no liability for decisions made in reliance on it. Nothing in this Section limits any specific, separately agreed advisory or brokerage engagement between SPI Marine and a client, which is governed by the terms of that engagement rather than this Site disclaimer.
5. Intellectual Property
All content on the Site, including Market Content, reports, graphics, trademarks, and underlying data compilations, is owned by or licensed to SPI Marine and is protected by copyright, trademark, and other intellectual property laws. This includes content prepared with the support of drafting or data-processing tools; SPI Marine's analysis, editorial review, and compilation of such content constitutes original work product of SPI Marine.
Any ideas, concepts, know-how, or techniques developed by SPI Marine in the course of operating the Site or delivering services remain the exclusive property of SPI Marine. Subject to Section 3, you may view and share links to published, non-gated content for legitimate business purposes, but may not republish, mirror, or incorporate it into a competing product or service without our prior written consent.
6. Gated Content and Registration
Certain content, including detailed trade lane analysis and premium market reports, requires you to submit contact information to access. You agree to provide accurate information when registering. Information submitted through registration forms is handled in accordance with our Privacy Policy, and by registering you consent to receive related content and communications as described there, with the ability to opt out at any time.
7. Third-Party Links
The Site may link to third-party websites for your convenience. We do not control and are not responsible for the content, accuracy, or practices of any linked site, and inclusion of a link does not imply endorsement. Use of third-party sites is at your own risk.
8. Disclaimer of Warranties
The Site and all content are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of accuracy, completeness, availability, or fitness for a particular purpose. We aim to keep the Site accurate and available but do not guarantee uninterrupted or error-free operation, and information may change without the Site being updated.
9. Limitation of Liability
To the fullest extent permitted by applicable law, SPI Marine excludes all liability for any loss or damage, including consequential or indirect loss, arising directly or indirectly from your use of the Site or reliance on any content, whether arising in contract, tort (including negligence), or otherwise. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law.
10. Termination
We may suspend or terminate your access to any part of the Site, including gated content or subscription services, at our discretion, including where we believe these Terms have been violated.
11. Governing Law and Jurisdiction
These Terms, and any dispute or claim arising out of or relating to these Terms or your use of the Site, are governed by the laws of the State of Texas, without regard to its conflict of laws principles. You agree to submit to the exclusive jurisdiction and venue of the state courts of Harris County, Texas, and the United States District Court for the Southern District of Texas, Houston Division.
12. General
If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force and effect. Our failure or delay in enforcing any provision does not constitute a waiver of our right to do so later, and no waiver of a breach will be treated as a waiver of any subsequent breach. Except as expressly stated, these Terms do not confer any rights on third parties who are not party to them.
